APYWA Terms of Service
This English version is provided for convenience. In the event of any conflict, the Korean version prevails.
1. Purpose
These Terms govern the use of the APYWA website and related services (the "Service") operated by APYLab Co., Ltd. (the "Company"), and set out the rights, obligations and responsibilities between the Company and members.
2. Definitions
- "Service" means the provision of digital-asset ratings, scores, reports, alerts and related information produced by the Company's patented automated rating model, via the website, email, API or other channels.
- "Member" means a person who agrees to these Terms and enters into a service agreement with the Company.
- "Free Member" means a member using part of the member-only features free of charge; "Paid Member" means a member who pays the fees set by the Company to use paid services.
- "Watchlist" means the feature that lets a member register digital assets of interest and receive alerts such as rating changes.
3. Posting and Amendment of Terms
- The Company posts these Terms on the Service so that members can easily review them.
- The Company may amend these Terms to the extent permitted by applicable Korean law, including the Act on the Regulation of Terms and Conditions and the Act on Consumer Protection in Electronic Commerce.
- Amendments are announced at least 7 days before the effective date, stating the effective date and reasons. Amendments unfavorable to members are announced at least 30 days in advance and notified by email.
- A member who does not reject the amended Terms by the effective date is deemed to have agreed. A member who disagrees may terminate the agreement.
4. Formation of the Agreement
- The agreement is formed when a user agrees to these Terms, applies for membership, and the Company accepts.
- Membership may be registered via email verification or a supported social account (Google, Kakao, etc.).
- The Company may refuse or later terminate membership if: (a) another person's information is used; (b) false information is provided; (c) the applicant is under 19; (d) membership was previously revoked for breach of these Terms; or (e) applicable law is otherwise violated.
5. Account Management
- Members are responsible for safeguarding their account and may not transfer or lend it to a third party.
- Members must promptly notify the Company upon becoming aware of unauthorized use of their account.
6. Nature of the Service
- The Company provides digital-asset ratings, scores, factor analysis, rating-change alerts, market overviews and analysis reports. Details and the scope available to each membership tier are posted on the Service.
- All information on the Service is reference information produced by the Company's rating model. It is not investment advice and does not constitute a recommendation to buy, sell or hold any digital asset, nor a guarantee of returns. Investment decisions and their outcomes are solely the member's responsibility.
- Ratings are updated on the Company's schedule (e.g., weekly) and may be delayed or changed depending on data sources, market conditions or system circumstances.
7. Paid Services, Payment and Refunds
- The Company may offer paid subscription plans (e.g., Basic, Pro) and institutional services. Product name, fees (including whether VAT is included), service period, payment methods and scope are stated on the Pricing page and the checkout screen.
- Payments are processed by the Company's contracted payment provider (PG) via credit/debit cards and other methods. Card numbers and other payment details are stored by the payment provider, not by the Company. Overseas cards are authorized in the currency and amount shown at checkout; exchange rates and foreign-transaction fees follow the card issuer's policy.
- Subscriptions renew and are charged automatically on the same date of each billing cycle (1 month) until cancelled. The Company emails the renewal date and amount at least 3 days before each renewal. Members may cancel renewal at any time in My Page; the Service remains available until the end of the paid period.
- Price increases are announced and notified at least 30 days before they take effect; a member who cancels before the effective date is not charged the increased price.
- Under the Act on Consumer Protection in Electronic Commerce, members may withdraw within 7 days of payment. Where paid content (full reports and briefings, grade history chart, expanded watchlist, etc.) has already been used, withdrawal may be limited for the portion used; the Company notifies this before payment. Termination after the 7-day period is refunded pro rata for the unused days.
- If the Company fails to provide paid services for 24 consecutive hours or more due to its own fault, the Company refunds fees for that period or extends the service period.
- Refunds are made to the original payment method and may take 3–7 business days depending on the payment provider and card issuer. Detailed withdrawal, cancellation and refund rules are set out in the Refund Policy, which forms part of these Terms.
- Services provided under a separate agreement to exchanges, institutions, professional investors and similar parties (PoC, monthly subscriptions, in-depth assessments, API) are governed by that agreement, which prevails over these Terms.
8. Member Obligations
Members shall not:
- collect Service data with automated tools (crawlers, scrapers, etc.), or redistribute, resell or publish it without the Company's prior written consent;
- quote or process ratings or reports in a way that misrepresents them as issued by the Company to third parties;
- misappropriate another person's account or information, or interfere with the normal operation of the Service;
- violate applicable law, these Terms or the Company's notices.
9. Intellectual Property
- Copyright and other intellectual-property rights in the Service, including the rating model, ratings, scores, reports, databases and screen designs, belong to the Company.
- Members may use the Service for personal, non-commercial reference only. Use beyond brief quotation with attribution ("APYWA") requires the Company's prior written consent.
10. Changes to or Suspension of the Service
- The Company may change or discontinue all or part of the Service for operational or technical reasons, with prior notice for material changes.
- The Service may be temporarily suspended for maintenance, force majeure, or failures at external data providers.
11. Termination and Restriction
- Members may terminate at any time via the account-deletion feature in My Page. Personal data is then handled under the Privacy Policy.
- The Company may restrict use or terminate the agreement after notice if a member breaches these Terms; notice may follow in urgent cases.
12. Disclaimer
- The Company does not warrant the accuracy, completeness or timeliness of information on the Service and is not liable for losses arising from investment or other decisions based on it.
- The Company is not liable for losses caused by errors or delays of external data providers (exchanges, on-chain data, social data, etc.).
- The Company is not liable in connection with free services except as required by applicable law; this does not apply to damage caused by the Company’s willful misconduct or gross negligence.
13. Governing Law and Disputes
- These Terms are governed by the laws of the Republic of Korea. Disputes are resolved by mutual consultation, failing which by the competent court under the Korean Civil Procedure Act.
- Members may also seek remedies through the Korea Consumer Agency or the Electronic Commerce Dispute Mediation Committee.
Addendum
These Terms take effect on 2026-11-01.
